Service Animal Case

A young child was severely injured in a restaurant by a dog presented to the public as a service animal. The case became more than a dog-bite lawsuit when the defense argued that claims against the physician who wrote service-animal letters for the dog’s owner should be treated as health care liability claims.

The Texas Supreme Court allowed the claims to move forward, clarifying that not every claim involving a physician is automatically a medical malpractice claim. The decision preserved the family’s access to court and created important guidance for future Texas cases.

What should have been an ordinary rideshare trip became a serious safety incident when a driver pulled a firearm and injured a passenger.
